1 i . <br /> Town of ftlaobpee <br /> ,I l lm <br /> 1 " <br /> \ '. 16 GREAT NECK ROAD NORTH <br /> m 5 <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> I <br /> i DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: David and Fira Schneider for a Special Permit SP-93-24 <br /> A Petition was filed by David and Fira Schneider of Needham, <br /> Massachusetts for a Special Permit under Section 174-17 of the Zoning <br /> By-laws for permission to build on a non-conforming lot in an R-5 <br /> zoning district on property located at 3 Hillside Avenue (Map 49, <br /> Block 188) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on March 5 and March 12, 1993, a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, March 24, 1993 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> John J. Friel, Michael A. Makunas and Jamie Regan. <br /> Engineer Joseph Harvey represented the applicant and informed <br /> the Board that the owner had received a Variance in 1990 to allow <br /> reduction in the set-back requirements but had postponed construction. <br /> Revised plans were presented which met the set-back requirements on the <br /> lot when it was formed. <br /> The Board determined that the planned construction was consistent <br /> o, with the neighborhood and would not be a detriment and that the use is <br /> in harmony with the general purpose and intent of the by-laws and <br /> complies with the provisions therein. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on March 24, 1993 to grant the Special Permit. The <br /> Permit is referenced by plans of Norman. Grossman revised March 1, 1993. <br />
