Tobin of Aagbpee <br /> r .a <br /> 'T 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> �nBLE cam• BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Joseph Bousa for a Special Permit SP-93-26 <br /> A Petition was filed by Joseph Bousa of Upper Saddle River, New <br /> Jersey for a Special Permit under Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a walk, ramp and float to replace <br /> an existing dock in an R-3 zoning district on property located at <br /> 30 Spoondrift Way (Map 111, Block 124) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on April 9 and April 16, 1993, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, April 28, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Engineer John Slavinsky represented the applicant and presented <br /> plans for the replacement of an existing dock. He informed the <br /> Board that the Conservation Commission had requested that the length <br /> be extended from 17' to 22' . No comments were received from abutters. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on April 28, 1993 to grant the Special Permit. The Permit <br /> is referenced by plans of Cape & Islands Engineering revised April 20, <br /> 1993. <br /> The Board found that the structure will not interfere with free <br /> passage of travel by water or land or cause or contribute to the <br /> disruption of the coastal environment. The Board determined that the <br /> use is in harmony with the purpose and intent of the by-laws and <br /> complies with the provisions therein. <br />
