Tobin of Aagbpee r .a 'T 16 GREAT NECK ROAD NORTH MASHPEE, MA 02649 �nBLE cam• BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT RE: Joseph Bousa for a Special Permit SP-93-26 A Petition was filed by Joseph Bousa of Upper Saddle River, New Jersey for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for permission to construct a walk, ramp and float to replace an existing dock in an R-3 zoning district on property located at 30 Spoondrift Way (Map 111, Block 124) Mashpee, Massachusetts. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on April 9 and April 16, 1993, a copy of which is attached hereto and made a part hereof. A public hearing was held on the Petition at the Mashpee Town Hall on Wednesday, April 28, 1993 at 7:30 P.M. at which time the following members of the Board of appeals were present and acting throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. Engineer John Slavinsky represented the applicant and presented plans for the replacement of an existing dock. He informed the Board that the Conservation Commission had requested that the length be extended from 17' to 22' . No comments were received from abutters. Upon motion duly made and seconded the Board of Appeals voted unanimously on April 28, 1993 to grant the Special Permit. The Permit is referenced by plans of Cape & Islands Engineering revised April 20, 1993. The Board found that the structure will not interfere with free passage of travel by water or land or cause or contribute to the disruption of the coastal environment. The Board determined that the use is in harmony with the purpose and intent of the by-laws and complies with the provisions therein.
