Wall for a Special Permit SP-93-30
A Petition was filed by Florence A. Wall of Mashpee.
Massachusetts for a Special Permit under Section 174-17 of
the Zoning 'By-laws .for permission to enclose a farmer's
porch in an R-3 zoning district on property located at 146
Ninigret Avenue (Map 65, Block 79 ) Mashpee , Massachusetts .
( Owner of record: Geoffrey T. & Florence A. Wall) .
Notice was duly given to abutters in accordance with
Massachusetts General Laws Chapter 40A. Notice was given
by publication in The Enterprise, a newspaper of general
circulation in the Town of Mashpee, on April 23 , 1993 and
April 30 , 1993 , a copy of which is attached and made a part
hereof .
A Public Hearing was held on the Petition at the
Mashpee Town Hall at 7 : 30 P .M. on Wednesday. May 12 . 1.993
at which time the following members of the Board of Appeals
were present and acting throughout : John J . Friel, Michael
A. Makunas and Edward M. Govoni .
Geoffrey Wall represented the applicant and advised
the Board that he wanted to enclose the farmer' s porch and
move a bulkhead to the opposite side of the house. He was
informed that the size of the bulkhead would have to be
reduced by 10" to maintain the approved lot coverage . At
the June 9 , 1993 meeting of the Board Mr . Wall confirmed
that the size of the bulkhead had been reduced.
The Board found that the use is in general harmony
with other permitted uses in this zoning district . the
change or extension is not substantially more detrimental
than the existing condition and that relief can be granted
without derogating from the intent of the by-law or without
detriment to the neighborhood.
