MA 02649
OLE BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
RE: Roland Gatturna for a Special Permit SP-93-32
A Petition was filed by Roland Gatturna for a Special Permit under
Section 174-25.I.9 of the Zoning By-laws for an existing ramp and
floats in Ann's Cove in an R-3 zoning district on property located
at 74 Summersea Road (Map 105, Block 39) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on April 23 and April 30, 1993, a copy of which is attached hereto and
made a part hereof.
A public hearing was held on the Petition at the Mashpee Town Hall
on Wednesday, May 12, 1993 at 7:30 P.M. at which time the following
members of the Board of Appeals were present and acting throughout:
John J. Friel, Michael A. Makunas and Edward M. Govoni.
Engineer John Slavinsky represented the applicant and explained
that the applicant was seeking an amnesty license for an existing
walkway, ramp and float. No comments were received from abutters.
The Board made the following findings:
1. the structure will not unduly interfere with free passage
of travel by water or land or cause disruption to the coastal environment.
2. the use is in harmony with the general purpose and intent of
the Zoning By-laws.
3. the use complies with the provisions of the Zoning By-laws.
