Ir <br /> �/pproH��4�U <br /> _ Tobin of ;ffiaobpee <br /> 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> T"B1f �O� BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Donald Laffert for a Special Permit SP-93-33 <br /> A Petition was filed by Donald Laffert of Needham, Massachusetts <br /> for a Special Permit under Section 174-25.I.9 of the Zoning By-laws for <br /> permission to reconstruct a pier, ramp and float in Ockway Bay in an <br /> R-3 zoning district on property located at 146 Summersea Road (Map 105, <br /> I Block 58) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on April 23 and April 30, 1993, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall ' <br /> on Wednesday, May 12, 1993 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Engineer John Slavinsky represented the applicant and presented <br /> .revised plans. He explained that the Summersea Village Association <br /> had requested that the walkway be raised and that the applicant had <br /> complied and agreed that Summersea Village Association members could <br /> have access to the dock. <br /> The Board made the following findings: <br /> 1. the structure will not unduly interfere with free passage of <br /> travel by water or land or cause disruption to the coastal environment. <br /> 2. the use is in harmony with the general purpose and intent of <br /> the Zoning By-laws. <br /> 3. the use complies with the provisions of the Zoning By-laws. <br />
