Smith for a Special Permit <br /> SP-93-42 <br /> A Petition was filed by Daniel C. and Janice G. Smith <br /> of S . Hadley, Massachusetts for a Special Permit under <br /> Section 174-25 . 1 . 9 of the Zoning By-laws for an existing <br /> pier, ramp and float in an R-3 zoning district on property <br /> located at 26 waterway (Map 105, Block 205) Mashpee, <br /> Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of ,Mashpee on May 21 and May 28 , <br /> 1993 , a copy of which is attached hereto and made a part <br /> hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, June 9 , 1993 at 7 : 30 P .M. at <br /> which time the following members of the Board of Appeals <br /> were present and acting throughout : John J . Friel , Michael <br /> A. Makunas and Edward M. Govoni . <br /> Debbie Hanes of Lelito Environmental Consultants <br /> represented the applicants and explained that the owners are <br /> applying for an amnesty license . She stated that the dock <br /> had been built in the early 1980 • s and that no changes were <br /> planned in the structure . No comments were received from <br /> abutters . <br /> The Board determined that the structure will not <br /> interfere with free passage of travel by water or land or <br /> cause or contribute to the substantial disruption or <br /> degradation on the marine or coastal environment . <br /> The Board found that the use is in harmony with the <br /> general purpose and intent of the zoning by-laws and use <br /> complies with the provisions of the by-law. <br />
