��F.TON1. <br /> �s; U town of Aagbpee <br /> • 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> BLE CO•"+~� <br /> BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> RE: David J. and Marcia Holden for a Special Permit - SP-93-38 <br /> A Petition was filed by David J. and Marcia Holden of Norwell, <br /> Massachusetts for a Special Permit under Section 174-25.I.9 for an <br /> existing pier, ramp and float in Hamblin Pond.'in an R-3 zoning district <br /> on property located at 62 Bayview Road (Map 119, Block 52) Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A° Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on May 21 and May 28, 1993, a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, June 9, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Engineer David Sanicki represented the applicant and presented <br /> plans for the construction of a new pier, ramp and float to replace <br /> an existing structure. The Board found that the application did not <br /> include the request for new construction but determined that the <br /> hearing could proceed with clarification that an existing structure <br /> was to be removed. Comments were received from Conservation questioning <br /> the water depth. Mr. Sanicki explained that he had informed Conservation <br /> that the pier would be used for a 12' Boston Whaler which is used to <br /> access a larger boat on a mooring. <br /> The Board found that the use was in harmony with the general <br /> purpose and intent of the By-laws and complied with the provisions <br /> therein. The Board determined that the structure :would not interfere <br /> with free passage of travel by water or land or cause disruption to <br /> Ithe marine or coastal environment. <br />
