I . 0 of the Zoning <br /> ' By-laws for permission to vary the setback requirements for <br /> commercial centers in a C-1 zoning district on property <br /> • located at 39 Nathan Ellis Highway, (Map 74 , Block 22 ) <br /> Mashpee , MA. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on June 15 and June 22 , <br /> t 1993 , a copy of which is attached and made a part hereof . <br /> 1 A Public Hearing was held on the Petition at the Mashpee <br /> ; Town Hall on Wednesday, June 30 , 1993 at 7 : 30 P .M. at which <br /> time the following members of the Board of Appeals were , <br /> present and acting throughout : John J. Friel ; Michael A. <br /> Makunas and Edward M. Govoni . <br /> +, Douglas Storrs of Fields Point represented the applicant <br /> and informed the Board that the requested Variance was the <br /> same as that granted earlier under Section 174-31 . <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously to grant a Variance on the set-backs from <br /> Route 151 . The Variances are referenced by plans of BSS Design <br /> dated 3/25/93 . <br /> The Board made the following findings : <br /> �I 1 . there are circumstances relating to the shape and <br /> topography of the lot which affect the land in question but <br /> Inot the zoning district in which it is located. <br /> 2 • a literal enforcement of the provisions of the zoning <br /> by-laws would involve substantial hardship. <br /> i <br />
