Ball of Mashpee, <br /> Massachusetts, for a Special Permit under Section 174-17 of the Zoning <br /> By-laws for permission to alter an existing non-conforming seasonal <br /> structure by moving structure from approximately 6' to 15' from the <br /> westerly property line in an R-3 zoning district on property located <br /> at 53 Amy Brown Road (Map 109, Block 1) Mashpee, Massachusetts. <br /> (Owner of record: Richard E. Ball) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on June 25 and July 2, 1993, a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 14, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Attorney Kevin Kirrance represented the Applicants and presented <br /> plans of an existing seasonal structure which the Balls wish to <br /> relocate and reconstruct. Said structure is in need of significant <br /> repair and is situated within six (6') feet of the existing sideline. <br /> The proposed new location will be fifteen (151) feet from the property <br /> line so as to comply with existing zoning requirements. The proposed <br /> renovated and/or reconstructed structure will be a one and one-half <br /> story 20' x 30' single-family residence replacing the 16.2' x 22.2' <br /> existing non-conforming structure. The new structure will be serviced <br /> by a septic system which complies with Title V thereby eliminating its <br /> use of an existing cesspool in conjunction with the abutting parcel. <br /> The structure which is the subject matter of this Permit is now <br /> situated on an "Approval Not Required" lot shown on a Plan <br /> recently signed by the Planning Board. <br />
