ToWn of f aobpee
^i ?
• 16 GREAT NECK ROAD NORTH
e'QAlee MASHPEE, MA 02649
BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
Re: Steven and Barbara Ball for a Special Permit SP-93-49
A Petition was filed by Barbara and Steven R. Ball of Mashpee,
Massachusetts, for a Special Permit under Section 174-17 of the Zoning
By-laws for permission to alter an existing non-conforming seasonal
structure by moving structure from approximately 6' to 15' from the
westerly property line in an R-3 zoning district on property located
at 53 Amy Brown Road (Map 109, Block 1) Mashpee, Massachusetts.
(Owner of record: Richard E. Ball) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws, Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on June 25 and July 2, 1993, a copy of which is attached hereto and
made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, July 14, 1993 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni.
Attorney Kevin Kirrance represented the Applicants and presented
plans of an existing seasonal structure which the Balls wish to
relocate and reconstruct. Said structure is in need of significant
repair and is situated within six (6') feet of the existing sideline.
The proposed new location will be fifteen (151) feet from the property
line so as to comply with existing zoning requirements. The proposed
renovated and/or reconstructed structure will be a one and one-half
story 20' x 30' single-family residence replacing the 16.2' x 22.2'
existing non-conforming structure. The new structure will be serviced
by a septic system which complies with Title V thereby eliminating its
use of an existing cesspool in conjunction with the abutting parcel.
The structure which is the subject matter of this Permit is now
situated on an "Approval Not Required" lot shown on a Plan
recently signed by the Planning Board.
