i <br /> t TON,y� <br /> 4,U <br /> Tobon of ;ffiaobpee <br /> 1� <br /> 16 GREAT NECK ROAD NORTH <br /> �r BLe c�5 MASHPEE, MA 02649 <br /> Decision <br /> for a Special Permit <br /> RE: Daniel J. and Sandra Donahue for a Special Permit <br /> SP-93-54 <br /> A Petition was filed by Daniel J. and Sandra <br /> Donahue of Mashpee, Massachusetts for a Special Permit <br /> under Section 174-25 .2 .9 of the Zoning By-laws for an <br /> existing dock in John' s Pond in an R-5 zoning district <br /> on property located at 79 Sunset Circle (Map 64, Block <br /> 7) Mashpee, Massachusetts . <br /> Notice was duly given to abutters in accordance <br /> With Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in The Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on July 23 <br /> and July 30 , 1993, a copy of which is attached hereto <br /> and made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, August 11 , 1993 at 7 : 30 <br />" P .M. at which time the following members of the Board of <br /> Appeals were present and acting throughout : John J. <br /> Friel, Michael A. Makunas and Edward M. Govoni . <br /> Engineer John Slavinsky represented the applicant <br /> and explained that he was applying for an amnesty <br /> license for an existing dock. <br /> The Board determined that the structure will not <br /> interfere with free passage of travel by water or land <br /> or cause or contribute to the substantial disruption or <br /> degradation on the marine or coastal environment. <br /> The Board found that the use is in harmony with the <br /> general purpose and intent of the zoning by-laws and use <br /> complies with the provisions of the by-law. <br />
