True for a Special Permit <br /> SP-93-60 <br /> A Petition was filed by Donald S . True of Mashpee, <br /> Massachusetts for a Special Permit under Section <br /> 174-25 . I . 9 of the Zoning By-laws for an existing pier <br /> and dock in Johns Pond in an R-5 Zoning district on <br /> property located at 53 James Circle (Map 71 , Block 43 ) <br /> Mashpee, Massachusetts. ( Owner of record: Patricia K. <br /> True TR . Patricia K. True Rev. Trust ) . <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in The Enterprise , a newspaper of <br /> general circulation in the Town of Mashpee on July 23 <br /> and July 30 , 1993 , a copy of which is attached hereto <br /> and made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, August 11, 1993 at 7 : 30 <br /> P.M. at which time the following members of the Board of <br /> Appeals were present and acting throughout: John J. <br /> Friel , Michael A. Makunas and Cheryl A. Hawver . <br /> Engineer Robert Raymond represented the applicant <br /> and explained that he was applying for an amnesty <br /> license for an existing dock . <br /> The Board deter-mined that the structure will not <br /> interfere with free passage of travel by water or land <br /> or cause or contribute to the substantial disruption or <br /> degradation on the marine or coastal environment. <br /> The Board found that the use is in harmony with the <br /> general purpose and intent of the zoning by-laws and use <br /> complies with the provisions of the by-law. <br /> r <br />
