Gabriel TR. <br /> a of Brockton, Massachusetts for a Variance from <br /> Section 174-32 of the Zoning By-laws to allow for <br /> construction of a single family residence on a <br /> roadway of permeable material in an R-3 zoning <br /> district on property located at 10 Wading Place <br /> Road (Map 111, Blocks 25 and 26 ) Mashpee, <br /> Massachusetts . (Owner of record: Christopher <br /> Burden TR. N. S. Units Nominee Trust ) . <br /> Notice was duly given to abutters in <br /> accordance with Massachusetts General Laws Chapter <br /> 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee on August 6 and August 13, <br /> 1993, a copy of which is attached hereto and made a <br /> part hereof . <br /> A Public Hearing was held on the Petition at <br /> the Mashpee Town Hall on Wednesday, August 25, 1993 <br /> at 7 : 30 P .M. at which time the following members of <br /> the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and <br /> Edward M. Govoni. <br /> Attorney Mark Gildea represented the applicant <br /> and reviewed land court plans of three lots off of <br /> Wading Place Way in New Seabury which are included <br /> t. in the 1964 Special Permit. The plan includes a <br /> 201 roadway. <br /> He explained that the lots were reviewed by <br /> the Conservation Commission in 1992 and that the <br /> Order of Conditions allowing construction on them <br /> contains the following Special Condition: "The <br /> driveway shall be constructed of permeable material <br /> and the roadway shall be constructed to pitch away <br /> from the wetland and be of permeable material .
