MIX
• T Town of Alaobpee
16 GREAT NECK ROAD NORTH
9.ps,sTAeLFF`'• MASHPEE, MA 02649
BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
RE: Robert G. Marsters for a Special Permit SP-93-73
A Petition was filed by Robert G. Marsters of Mashpee, Massachusetts
for a Special Permit under Section 174-17 of the Zoning By-laws for
permission to expand a non-conforming dwelling with a 14' x 24'
addition and dormer in an R-5 zoning district on property located at
74 Lakewood Drive (Map 28, Block 41) Mashpee, Massachusetts. (Owner
of record: Robert G. and Stella S. Marsters) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on August 20 and August 27, 1993, a copy of which is attached hereto
and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, September 8, 1993 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: John J.. Friel,. Michael A: Makunas.:and Jamie Regan.
Mr. Marsters informed the Board that the Special Permit request
was for the dormer only and that the addition had been completed.
He explained that the addition of the dormer would not 'increase
the number of bedrooms. No comments were received from abutters.
The Board determined that the proposed expansion would not be
more detrimental to the neighborhood than the existing non-conforming
use. The Board found that the use was in harmony with the. purpose and
intent of the zoning ordinance and complied with the provisions therein.
