Inc. for a Variance V-93-76 <br /> A Petition was filed by Fenucci Bros. Inc. of Mashpee, Massachusetts <br /> d/b/a Davy's Locker, for a Variance from Section 174-55.0 of the <br /> Zoning By-laws for permission to place a sign within 12' of the lot <br /> line in an R-5 zoning district on property located at 470 Main St. <br /> (Map 27, Block 21) Mashpee, MA. (Owner of record: Diane Cloutier TR.) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on August 20 and August 27, 1993, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, September 8, 1993, at 7:30 P.M. at which time <br /> the following members of the Board. of Appeals were present and <br /> acting throughout: John J. Friel, Michael A. Makunas and Jamie Regan. <br /> Jeff Delinsky represented the applicant and explained that the <br /> sign is set back 4 1/2' from the road and was placed at a 6' height <br /> to allow visability from Ashumet Road to Route 130. He informed <br /> the Board that the signage was necessary to identify the restaurant <br /> in both directions. <br /> The Board found that the location of the non-conforming building <br /> on the lot created a difficulty in complying with- the By-laws and that a <br /> literal enforcement of the By-laws would create a hardship. The <br /> Board determined that relief could be granted without nullifying the <br /> intent of the By-laws and without detriment to the public good. <br /> I , <br /> I. <br />
