McCormack for a Special <br /> Permit - SP-93-79 <br /> i <br /> A Petition was filed by William M. and Geraldine H. <br /> McCormack of Short Hills, New Jersey for a Special <br /> Permit under Section 174-25 . 1 .9 of the Zoning By-laws <br /> for an extension to an existing pier in Jehu Pond in an <br /> R-3 zoning district on property located at 77 Tide Run <br /> (Map 120 , Block 190 ) Mashpee. Massachusetts. <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in The Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on September <br /> 3 and September 10 , 1993, a copy of which is attached <br /> hereto and made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, September 22, 1993 at <br /> 7 : 30 P .M. at which time the following members of the <br /> Board of Appeals were present and acting throughout: <br /> John J . Friel , Michael A. Makunas and Cheryl A. Hawver . <br /> Environmental Scientist Peggy Fantozzi represented <br /> the applicants and informed the Board that the owner was <br /> applying for an amnesty license. She explained that the <br /> Special Permit request was to allow a three foot by <br /> eleven foot ramp extension to the pier of record to <br /> reach a water depth and orientation that is sensitive to <br /> the existing environmental conditions in the immediate <br /> area and is necessitated by the location of other piers <br /> and the topography of the lot. The applicant has <br /> received approval of the project from the Conservation <br /> Commission. <br /> The Board determined that the structure will not <br /> interfere with free passage of travel by water or land <br /> or cause or contribute to the substantial disruption or <br /> degradation on the marine or coastal environment . <br /> The Board found that the use is in harmony with the <br /> general purpose and intent of the zoning by-laws and use <br /> complies with the provisions of the by-law. <br />
