Beran for a Special Permit - SP-93-81 <br /> A Petition was filed by Ronald H. Beran of Acton, <br /> Massachusetts for a Special Permit under Section <br /> 174-25. I . 9 of the Zoning By-laws for an existing <br /> walkway, ramp and float in Popponesset Creek in an R-3 <br /> zoning district on property located at 156 Waterway (Map <br /> 105, Block 238 ) Mashpee, MA. ( Owner of record: <br /> Patricia M. Beran. ) <br /> Notice was duly given to abutters in accordance <br /> with Massachusetts General Laws Chapter 40A. Notice was <br /> given by publication in The Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on September <br /> 24 and October 1, 1993, a copy of which is attached <br /> hereto and made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, October 13 , 1993 at 7 :30 <br /> P .M. at which time the following members of the Board of <br /> Appeals were present and acting throughout: John J. <br /> Friel, Michael A. Makunas and Edward M. Govoni . <br /> Engineer John Slavinsky represented the applicant <br /> and explained that the owner was applying for an amnesty <br /> license and that the only changes in the structure would <br /> be the replacement of pipe piles with wood piles . <br /> Conservation has approved the plans . <br /> The Board determined that the structure will not <br /> interfere with free passage of travel by water or land <br /> or cause or contribute to the substantial disruption or <br /> degradation on the marine or coastal environment. <br /> The Board found that the use is in harmony with the <br /> general purpose and intent of the zoning by-laws and use <br /> complies with the provisions of the by-law. <br /> JCT 2 6 1993 I ,'; <br />
