Ball for a Special Permit SP-93-83 <br /> A Petition was filed by Barbara and Steven R. Ball of <br />+ Mashpee, Massachusetts for a Special Permit under Section <br /> 174-17 of the Zoning By-laws for permission to expand a <br /> non-conforming structure in an R-3 Zoning district on property <br /> located at 53 Amy Brown Road (Map 109 , Block 1 ) Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on September 24 and <br /> October 1 , 1993 , a copy of which is attached hereto and made a <br /> part hereof . <br /> A Public Hearing was held on the Petition at the Mashpee <br /> Town Hall on Wednesday, October 13, 1993 at 7 : 30 P.M. at which <br /> time the following members of the Board of Appeals were <br /> present and acting throughout: John J. Friel , Michael A. <br /> Makunas and Edward M. Govoni . <br /> Steven Ball represented his Petition and informed the <br /> Board that he had received a Special Permit in 1993 for the <br /> expansion of a non-conforming structure and would like to make <br /> some plan changes . <br />' The Board of Appeals made the following findings: <br /> C1 . the use is in harmony with the general purpose and <br /> intent of the by-laws. <br /> 2 . the proposed structure and the proposed <br /> changes will not result in a structure or use which <br /> is more detrimental to the neighborhood than the <br /> prior non-conforming structure and its use . <br /> 3 . the plans of the proposed structure and its location <br /> on the lot comply with the general provisions set <br /> forth within the by-laws . <br />
