NN ToWn of ftlagbpee <br /> 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> f DECISION- <br /> , <br /> FOR A SPECIAL PERMIT <br /> RE: Waquoit Bay National Estuarine Research Reserve SP-93-95 <br /> A Petition was filed by the Waquoit Bay National Estuarine <br /> Research Reserve for a Special Permit under Sections 174-25.H.6 and <br /> a 17.4-25.1.9 of the Zoning By-laws for permission to construct a temporary <br /> 1 research structure similar to a dock and flot. The structure will be <br /> used to study the environmental effects of dock construction, use and <br /> removal. The proposed study site is the mouth of the Great River on <br /> a 10-acre parcel of land (Map 124, Block 69) Mashpee, MA. (Owner of <br /> record: Town of Mashpee) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was. given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 8 and October 15, 1993, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, October 27, 1993 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Edward M. Govoni and Cheryl A. Hawver. <br /> Conservation Agent Robert Sherman and Dr. Richard Crawford of <br /> WBNERR represented the Petition and informed the Board that the <br /> research involves the effect of docks on eel grass and shellfish and <br /> the effect of boat action at the docks. They said the study would <br /> be done over three years at which time the dock would be removed <br /> and the study would continue to monitor the area during the recovery <br /> period. No objections were received from abutters. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on October 27, 1993 to grant the Special Permit. The <br />.:r <br /> Board determined that the structure will not interfere with free <br /> passage of travel by water or landor-cause or contribute to the <br /> degradation of the coastal environment.
