1 <br /> i <br /> Board of Appeals Donald Priestly V-93-97 2 . <br /> The Board of Appeals , after carefully considering all <br /> of the facts and evidence submitted at the hearing, made the <br /> following findings: <br /> 1 . the subject lot could be combined with the <br /> adjacent lot (Map 49 , 119 ) to meet frontage and side setback <br /> requirements <br /> 2 . a literal enforcement of the provisions of the <br /> by-law on lot size requirements would involve substantial <br /> hardship to the owner. <br /> 3 . relief could be granted without detriment to the <br /> public good. <br /> 4 . relief could be granted without nullifying or <br /> derogating from the intent of the by-law. <br /> Upon motion duly made and seconded, the Board of <br /> Appeals voted unanimously on November 22 , 1993 to grant a <br /> Variance on lot size subject to the condition that lots at <br /> 28 Hilltop Road (Map 49 , Block 118 ) and 32 Hilltop Road (Map <br /> 49 , Block 119 ) be combined and that only one residence be <br /> constructed on the combined lots . <br />
