XoWn of Oaobpee <br /> a <br /> 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION - NOTICE OF APPEAL <br /> A <br /> RE: S. Joseph DiMaggio - N.O.A. 93-91 <br /> A Petition was filed by S. Joseph DiMaggio of Mashpee, <br /> Massachusetts appealing the Decision of the Building <br /> Inspector dated August 27 , 1993 concerning existing use of <br /> land in an R-5 zoning district at 135 Main Street (Map 37, <br /> Block 58 ) Mashpee, Massachusetts . <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in The Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on October 22 and <br /> October 29 , 1993, a copy of which is attached hereto and <br /> made a part hereof . <br /> A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, November 10 , 1993 at 7 : 30 <br /> • P.M. at which time the following members of the Board of <br /> Appeals were present and acting throughout: John J. Friel , <br /> Michael A. Makunas and Edward M. Govoni . <br /> Attorney Kevin Kirrane represented the applicant and <br /> reviewed the Building Inspector ' s decision . which claimed an <br /> unauthorized expansion of non-conforming uses . He informed <br /> the Board that a full service gasoline station had been <br /> constructed on the property in the 1970 ' s when this Zoning <br /> District was zoned for business use. In addition a towing <br /> company, auto repair and bus company were operated from the <br /> site prior to Mr . DiMaggio' s purchase of the property. <br /> Mr. Kirrane explained that Mr. DiMaggio had received a <br /> Building Permit in 1983 for the expansion of the garage to <br /> accomodate bus repairs and has had licenses for the <br /> operation of a used car dealership. <br />
