MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Daniel A. Thomas and Douglas A. Mohns for a Special Permit <br /> SP-92-13 <br /> A Petition was filed by Daniel A. Thomas and Douglas A. Mohns <br /> -for a Special Permit under Section 174-25.I.9 of the Zoning By-laws <br /> for permission to construct a pier, ramp and float in an R-3 zoning <br /> district on property located at 57 Frog Pond Close (Map 90, Block 80) <br /> Mashpee, MA. (Owner of record: Daniel A. and Katherine I. Thomas) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 21 and February, 28; 1992, a copy of which .is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 11, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Cheryl A. Hawver'and John J. Friel. . <br /> Mr. Thomas explained that he and his direct abutter-were proposing <br /> to build a joint dock on his property to replace an old dock and <br /> shed. He stated that he had reviewed plans with the Conservation <br /> and Shellfish Commissions and they considered them an improvement <br /> on existing conditions. <br /> The Board found that the use is in harmony with the general <br /> purpose and intent of the zoning bylaws and complies with the provisions <br /> therein. The Board determined that the structure would not interfere <br /> with the free passage of travel by water or cause disruption to <br /> the marine or coastal environment. <br />
