MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Daniel A. Thomas and Douglas A. Mohns for a Variance V-92-18 <br /> A Petition was filed by Daniel A. Thomas and Douglas A. Mohns <br /> for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the side line setback in an R-3 zoning district on property <br /> located at 57 Frog Pond Close (Map 90, Block 80) Mashpee, MA. (Owner <br /> of record: Daniel A. and Katherine I. Thomas) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February. 21 and February 28, 1992, a copy of which is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 11, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Cheryl A. Hawver and John J. Friel. <br /> Engineer Michael Borselli informed the Board that Mr. Thomas <br /> and Mr. Mohns were proposing to build a joint dock and that the <br /> topography of the lot (Map 90, Block 80) dictated the placement <br /> within 2' of the northerly side line. He explained that this location <br /> was clear of trees and would not require removal of vegetation on <br /> the bank. <br /> The Board found that there were circumstances relating to the <br /> topography of the lot which created,a hardship and that relief could <br /> be granted without derogating from the intent of the bylaws or without <br /> detriment to the public good. <br /> r <br />
