MA 02649 <br /> BOARD OF APPEALS <br /> i <br /> DECISION <br /> FOR A VARIANCE <br /> ' RE: Norman Belliveau for a Variance V-92-11 <br /> A Petition was filed by Norman Belliveau of Newton, MA for <br /> a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front yard setback in an R-5 zoning district on property <br /> located at 41 Lakeview Drive (Map 40, Block 51) Mashpee, MA. (Owner <br /> of record: Prime Properties Limited Partnership) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on February 21 and February 28, 1992, a copy of which is attached <br /> hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 11, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Cheryl A. Hawver and John J. Friel. <br /> Engineer Robert Raymond 'represented the applicant and presented <br /> plans for the location of a house 25' from Lakeview Drive. He explained <br /> that the rear of the lot was a steep bank to Ashumet Pond and that <br /> the Conservation Commission had recommended placement of the house <br /> as far from the wetlands as possible. <br /> The Board found that the topography of the lot created a hardship <br /> and that relief could be granted without derogating from the purpose <br /> and intent of the bylaws or without detriment to the public good. <br /> I <br />
