MA 02649
BOARD OF APPEALS
i
DECISION
FOR A VARIANCE
' RE: Norman Belliveau for a Variance V-92-11
A Petition was filed by Norman Belliveau of Newton, MA for
a Variance from Section 174-31 of the Zoning By-laws for permission
to vary the front yard setback in an R-5 zoning district on property
located at 41 Lakeview Drive (Map 40, Block 51) Mashpee, MA. (Owner
of record: Prime Properties Limited Partnership) .
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on February 21 and February 28, 1992, a copy of which is attached
hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, March 11, 1992 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: Michael A. Makunas, Cheryl A. Hawver and John J. Friel.
Engineer Robert Raymond 'represented the applicant and presented
plans for the location of a house 25' from Lakeview Drive. He explained
that the rear of the lot was a steep bank to Ashumet Pond and that
the Conservation Commission had recommended placement of the house
as far from the wetlands as possible.
The Board found that the topography of the lot created a hardship
and that relief could be granted without derogating from the purpose
and intent of the bylaws or without detriment to the public good.
I
