MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Thomas F. and Bonnie A. Smith for a Special Permit <br /> A Petition was filed by Thomas F. and Bonnie A. Smith of Cotuit, <br /> Massachusetts for a Special Permit under Section 174-25.1. 1 of the <br /> Zoning By-laws for permission to construct a garage in an R-3 zoning <br /> district on property located at 266 Monomoscoy Road (Map 120, <br /> Block 57B) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on March 6 and March 13, 1992, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, March 25, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, John J. Friel and Edward M. Govoni. <br /> Engineer Charles Spohr represented the applicants and presented <br /> plans for a garage with living quarters on the second floor. The <br /> Building Inspector, Douglas Boyd, explained that the owner could not <br /> get a well or septic system permit and that the second floor of the <br /> structure could only be used for storage. Board members made the <br /> following findings: <br /> 1. the area is in a residential zone and the proposed use under <br /> ithe By-law was intended for accessory use to a primary dwelling. <br /> There was no primary dwelling on the lot. <br />
