T <br /> Board of Appeals Ronald Nation SP-92-34 2 . <br /> Attorney Joseph McQuade represented the applicant and <br /> presented plans for the removal of an existing structure and <br /> the replacement with a two story home on the same foundation. <br /> The existing structure was constructed in approximately 1939 <br /> prior to the adoption of zoning by-laws in the Town and <br /> Mashpee and the existing nonconformities are the front and <br /> side setbacks and total square feet of lot coverage . <br /> +Similar improvements have been done to other homes in the <br /> immediate neighborhood. Comments were received from two <br /> direct abutters in favor of the application and one abutter <br /> in opposition. <br /> ° The Board of Appeals made the following findings : <br /> 1 . the proposed construction will not be more <br /> non-conforming than the existing structure . <br /> 2 . the use is in harmony with the general purpose and <br /> intent of the zoning by-laws <br /> 3. the use complies with the provisions set forth <br /> within the by-laws <br /> 4 . the proposed construction will not be more <br /> detrimental to the neighborhood than the existing <br /> non-conforming use. <br />
