T
Board of Appeals Ronald Nation SP-92-34 2 .
Attorney Joseph McQuade represented the applicant and
presented plans for the removal of an existing structure and
the replacement with a two story home on the same foundation.
The existing structure was constructed in approximately 1939
prior to the adoption of zoning by-laws in the Town and
Mashpee and the existing nonconformities are the front and
side setbacks and total square feet of lot coverage .
+Similar improvements have been done to other homes in the
immediate neighborhood. Comments were received from two
direct abutters in favor of the application and one abutter
in opposition.
° The Board of Appeals made the following findings :
1 . the proposed construction will not be more
non-conforming than the existing structure .
2 . the use is in harmony with the general purpose and
intent of the zoning by-laws
3. the use complies with the provisions set forth
within the by-laws
4 . the proposed construction will not be more
detrimental to the neighborhood than the existing
non-conforming use.
