Board of Appeals Steven R. Ball SP-92-30 2 . <br /> Attorney Kevin Kirrane represented the applicant and . <br /> presented plans of an existing shed which Mr. Ball wishes to <br /> move to the location of a pre-existing shed which is in need <br /> of significant repair. The new location will be 4 ' from the <br /> property line to replace the existing shed 1 . 9 ' from the <br /> property line. Further permitting will be required by the <br /> Conservation Commission since said structure as proposed will <br /> be within 100 ' of a resource area. Comments were received <br /> from an abutter in opposition to the Petition. <br /> The Board of Appeals made the following findings : <br /> 1 . the proposed location of the structure is less <br /> non-conforming than the present site in that it will be <br /> further from the property line than the existing structure <br /> 2 . the accessory use is .in harmony with the general <br /> purpose and intent of the by-laws <br /> 3 . the use complies with the provisions of the by-laws <br /> 4 . the extension and change shall not be more <br /> detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on May 13, 1992 to grant the Special <br /> Permit. The Permit is referenced by plan B-352 of ARO <br /> Engineering revised 3/9/92 . <br />
