MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: George Gillmore for a Variance - V-92-38 <br /> A Petition was filed by George R. Gillmore of Cotuit, Massachusetts <br /> for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front yard setback requirements in an I-1 zoning district <br /> on property located at 37 Bowdoin Road (Map 54, Block 10) Mashpee, <br /> Massachusetts. (Owner of record: Stephen P. and Philip R. Holmes TRS.) <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on May 8 and May 15, 1992, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, May 27, 1992 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Douglas Cameron of Braman Engineering represented the applicant <br /> and presented revised plans for a building and landscaping on the site. <br /> He explained that a variance was required in the front setback to <br /> allow for the rear yard storage of heavy equipment. The original <br /> setback requirement was 75' in this area. No comments were received <br /> from abutters. The.Design_Reviewr-Committee had approved the revised plan. <br /> The Board of Appeals determined that the topography of the lot <br /> created a hardship affecting the land in question but not the zoning <br /> district in which it is located and that relief could be granted <br /> without derogating from the intent of the by-law or without detriment <br /> to the public good. <br />
