MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Christopher Noyes for a Special Permit SP-92-33 <br /> A Petition was filed by Christopher Noyes of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.A.8 of the <br /> Zoning By-laws for permission to convert basement space to an <br /> in-law apartment in an R-5 zoning district on property located at <br /> 85 Wilann Road (Map 46, Block 24) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on May 8 and May 15, 1992, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, May 27, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Mr. Noyes represented his Petition and explained that it had <br /> become necessary for his mother to live with him due to financial <br /> and medical reasons and he planned to convert basement space to a <br /> separate apartment. He agreed with the condition that occupancy be <br /> limited to his mother, Jenny Noyes, only. No comments were received <br /> from abutters. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on May 27, 1992 to grant the Special Permit with the <br /> restriction that the apartment would only be occupied by Jenny Noyes <br /> and that the permit will expire upon the abandonment of use by <br /> Mrs. Noyes. <br />
