BOX 1106 MASHPEE, MA 02649 BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT RE: MRL Realty Trust for a Special Permit SP-92-36 A Petition was filed by MRL Realty Trust, Victor L. Berman, Trustee, of. Newton Centre, Massachusetts for a Special Permit under Section 174-25.1.9 of the Zoning By-laws for permission to replace an 8' x 20' float with a 12' x 24' float and install 4 mooring piles in Popponesset Creek in an R-3 zoning district on property located at 7 Bight Circle (Map 106, Block 11) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 4OA. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee, on May 8 and May 15, 1992, a copy of which is attached hereto and made a part hereof. A public hearing was held on the Petition at the Mashpee Town Hall on Wednesday, May 27, 1992 at 7:30 P.M. at which time the following members of the Board of Appeals were present and acting throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. Engineer Michael McGrath represented the applicant and reviewed plans of an existing pier, ramp and float which had been approved by the Division of Waterways in 1968. He said that the Conservation Agent was opposed to increasing the width of the float and asked for an amendment to the plans to allow for an 8' x 24' instead of the 12' x 24' originally presented. No -comments were received from abutters. Upon motion duly made and seconded the Board of Appeals voted unanimously on May 27 to grant the Special Permit. The Permit is referenced by revised plans of Holmes and McGrath Inc. dated June 2, 1992. The plans include the proposed 8' x 24' float and 4 mooring piles.
