BOX 1106 <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: MRL Realty Trust for a Special Permit SP-92-36 <br /> A Petition was filed by MRL Realty Trust, Victor L. Berman, <br /> Trustee, of. Newton Centre, Massachusetts for a Special Permit under <br /> Section 174-25.1.9 of the Zoning By-laws for permission to replace <br /> an 8' x 20' float with a 12' x 24' float and install 4 mooring piles <br /> in Popponesset Creek in an R-3 zoning district on property located <br /> at 7 Bight Circle (Map 106, Block 11) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on May 8 and May 15, 1992, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, May 27, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Engineer Michael McGrath represented the applicant and reviewed <br /> plans of an existing pier, ramp and float which had been approved by <br /> the Division of Waterways in 1968. He said that the Conservation Agent <br /> was opposed to increasing the width of the float and asked for an <br /> amendment to the plans to allow for an 8' x 24' instead of the 12' <br /> x 24' originally presented. No -comments were received from abutters. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on May 27 to grant the Special Permit. The Permit is <br /> referenced by revised plans of Holmes and McGrath Inc. dated <br /> June 2, 1992. The plans include the proposed 8' x 24' float and 4 <br /> mooring piles. <br />
