MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Robert D. and Carolyn J. Kelley SP-92-41 <br /> A Petition was filed by Robert D. and Carolyn J. Kelley of <br /> Mashpee, Massachusetts for a Special Permit under Section 174-25.I.9 <br /> of the Zoning Byclaws for permission to construct a pier, ramp and <br /> float on Mashpee Pond on property located in an R-5 zoning district <br /> at 31 Birch Way (Map 27, Block 86) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on May 22 and May 29, 1992, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, June 10, 1992 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Engineer Christopher Costa represented the applicants and <br /> presented plans for the proposed pier, ramp and float which would <br /> extend 53 feet into the waters of Mashpee/Wakeby Pond. No comments <br /> were received from abutters. <br /> The Board of Appeals found that the use is in harmony with permitted <br /> uses in this zoning district and would not be a detriment to the surrounding <br /> neighborhood. The Board determined that the structure would not interefere <br /> with free passage of travel by water or land or cause disruption to <br /> the marine or coastal environment. <br />
