MA 02649 BOARD OF APPEALS DECISION FOR A SPECIAL PERMIT RE: James E. & Priscilla Ann Griffin for a Special Permit SP-92-27 A Petition was filed by James E. and Priscilla Ann Griffin of Worcester, MA for a Special Permit under Section 174-17 of the Zoning By-laws for permission to expand a non-conforming dwelling with a second floor room in an R-3 zoning district on property located at 70 Summersea Road (Map 105, Block 37) Mashpee, MA. Notice was fuly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Enterprise, a newspaper of general circulation in the Town of Mashpee on April 3 and April 10, 1992, a copy of which is attached hereto and made a part hereof. A public hearing was held on the 'Petition at the Mashpee Town Hall at 7:30 P.M. on Wednesday, April 22, 1992 at which time the following members of the Board of Appeals were present and acting throughout: Michael A. makunas, Cheryl A. Hawver and John J. Friel. Joan Muse and Architect Bruce Devlin represented the applicant and informed the Board that the property was being sold and the potential buyer wished to expand with the addition of a dormer to allow a second floor bedroom. No objections were received from abutters. The Board of Appeals determined that the use is in harmony with the general purpose and intent of the by-laws and complies with the provisions therein. The Board found that the extension, alteration and change would not be more detrimental to the neighborhood that the existing non-conforming use. Upon motion duly made and seconded the Board of Appeals voted unanimously on April 22, 1992 to grant the Special Permit. The Permit is referenced by Cape & Islands Plans dated March 10, 1992 and elevations by Devlin Custom Designs.
