Palank for a Special Permit SP-92-28 <br /> A Petition was filed by Edward A. and Martha M. Palank for a <br /> Special Permit under Section 174-17 of the Zoning By-laws for permission <br /> to expand a non-conforming structure with the addition of a deck in an <br /> R-3 zoning district on property located at 101 Daniel's Island Road <br /> (Map 100, Block 39) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on April 3 and April 10, 1992, a copy of which isoattached hereto and <br /> made a part hereuf. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, April 22, 1992 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Michael A. Makunas_, Cheryl A. Hawver and John J. Friel. <br /> Engineer John Slavinsky represented the applicants and presented <br /> plans for the construction of a deck at the side of the house. He <br /> explained that the shape of the lot and proximity to the wetlands <br /> prevented placement in any other location. No opposition was received <br /> from abutters. <br /> The Board found that the use is in harmony with the general <br /> purpose and intent of the by-laws and complies with the provisions <br /> therein. The Board determined that the extension and change would <br /> not be a detriment to the neighborhood. <br />
