(Tolutt ofJR
ashpre
 P. O. BOX 1108
RLE co" MASHPEE. MA 02609
BOARD OF APPEALS
DECISION
FOR A SPECIAL PERMIT
RE: Nicholas J. and Lillian P. Dayos for a Special Permit SP-92-24
A Petition was filed by Nicholas J. and Lillian P. Dayos of
North Falmouth, Massachusetts, for a Special Permit under Section
174-25.I.9 of the Zoning By-laws for the licensing of an existing
seasonal dock on Mashpee Pond in an R-5 zoning district on property
located at 30 Baker's Road (Map 20, Block 5) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on April 3 and April 10, 1992, a copy of which is attached hereto and
made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, April 22, 1992 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: Michael A. Makunas, Cheryl A. Hawver and John J. Friel.
Engineer David Sanicki represented the applicant and explained
that they are seeking the licensing of a seasonal dock. No comments
were received from the Conservation Commission or abutters.
The Board found that the use is in harmony with the general
purpose and intent of the by-laws and complies with the provisions
therein. The Board determined that the structure will not interfere
with the free passage of travel by water or cause disruption to the
coastal environment.
t
