MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Robert and Linda Sharkansky - V-92-25 <br /> A: Petition.was filed by Robert and Linda Sharkansky of Brockton, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> for permission to vary the setback requirements in an R-3 zoning <br /> district on property located at 14 Wheelhouse Lane (Map 120, Block 157) <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on April 3 and April 10, 1992, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, April 22, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, Cheryl A. Hawver and John J. Friel. <br /> Engineer Brian Zeffenfeld and Attorney Richard Terry represented <br /> the applicants. Mr. Zeffenfeld presented plans for an addition to the <br /> dining area. He informed the Board that the lot is in the flood plain <br /> and that the Conservation Commission would only allow the addition at <br /> the front of the house. Mr. Terry informed the Board that the addition <br /> does not encroach on any abutters and submitted a letter from a direct <br /> abutter in favor of the Petition. There was no opposition to the Petition. <br /> The Board found that the shape of the lot created a hardship affecting <br /> the lot in question but not the zoning district in which the land is <br /> located. The Board determined that relief could be granted without <br /> derogating from the intent of the by-law or without detriment to the <br /> public good. <br />
