MA 02649 <br /> BOARD OF APPEALS <br /> RE: Norman Belliveau for a Variance V-92-50 <br /> A Petition was filed by Norman Belliveau of Newton, MA for <br /> a Variance from Section 174-31 for permission to vary the setback <br /> requirements in an R-5 zoning district on property located at 41 <br /> Lakeview Drive (Map 40, Block 51) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on June 5. and June 12, 1992, a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, June 24, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Engineer Robert Raymond represented the applicant and informed <br /> the Board that an earlier Variance had been granted on the front <br /> setback but that the Conservation Commission now requested that the <br /> house be moved further back on the lot. <br /> The Board found that the topography of the lot created a hardship <br /> and that relief could be granted without derogating from the purpose <br /> and intent of the by-laws or without detriment to the public good. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on June 24, 1992 to grant a Variance allowing a 15' <br /> setback from Lakeview' Drive and a 12' sideline setback. The Variance <br /> is referenced by plans of ARO Engineering revised 5/15/92. <br />
