MA 02649
BOARD OF APPEALS
RE: Norman Belliveau for a Variance V-92-50
A Petition was filed by Norman Belliveau of Newton, MA for
a Variance from Section 174-31 for permission to vary the setback
requirements in an R-5 zoning district on property located at 41
Lakeview Drive (Map 40, Block 51) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee
on June 5. and June 12, 1992, a copy of which is attached hereto and
made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, June 24, 1992 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni.
Engineer Robert Raymond represented the applicant and informed
the Board that an earlier Variance had been granted on the front
setback but that the Conservation Commission now requested that the
house be moved further back on the lot.
The Board found that the topography of the lot created a hardship
and that relief could be granted without derogating from the purpose
and intent of the by-laws or without detriment to the public good.
Upon motion duly made and seconded the Board of Appeals voted
unanimously on June 24, 1992 to grant a Variance allowing a 15'
setback from Lakeview' Drive and a 12' sideline setback. The Variance
is referenced by plans of ARO Engineering revised 5/15/92.
