V1, <br /> it�' 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> ABLE c� BOARD OF APPEALS <br /> DECISION <br /> FOR THE MODIFICATION OF A SPECIAL PERMIT <br /> RE: Cape Cod Restaurants d/b/a Picnic Box SP-92-52 <br /> A Petition was filed by Cape Cod Restaurants Inc. d/b/a Picnic Box <br /> for a Modification of Special Permit 88-04-034 issued to Triton Management <br /> to allow for the outdoor sale of produce and flowers under Section 174-25.F.5 <br /> of the Zoning By-laws in a C-1 zoning district on property located at <br /> 518 Falmouth Road (Map 74, Block 16) Mashpee, MA. (Owner of record: <br /> Fields Point Ltd. Partnership) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on June 26 and July 3, 1992, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 15, 1992 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> i <br /> John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Attorney Mark Gildea represented the applicant and stated that <br /> there was public support for the fruit stand and that the only complaint <br /> had come from the Building Inspector. Board members discussed the <br /> traffic conditions at the Rotary and the fact that there were several <br /> curb cuts and suggested that plans be submitted for improving the <br /> traffic flow. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on July 15, 1992 to modify Special Permit 88-04-034 to <br /> allow for the outside sale of produce and flowers subject to the <br /> following conditions: <br />
