Cushner for a Special Permit SP-92-54 <br /> A Petition was filed by Richard M. and Estelle G. Cushner of <br /> Tewksbury, Massachusetts for a Special Permit under Section 174-25.1.9 <br /> of the Zoning By-laws for permission to construct a permanent timber <br /> pier in the waters of Great River to replace an existing seasonal pier <br /> in an R-3 zoning district on property located at 22 Samoset Road <br /> (Map 125, Block 65) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on July 10 and July 17, 1992, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 29, 1992 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Attorney Kevin Kirrane and Engineer Michael McGrath represented <br /> the applicant. Mr. Kirrane explained that there was a temporary dock <br /> at the location which will be changed to a permanent structure. <br /> Mr. McGrath stated that the current seasonal removal of a temporary <br /> dock caused more environmental damage than a permanent pier. There <br /> were no comments from abutters. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on July 29, 1992 to grant the Special Permit. The Permit <br /> is referenced by Holmes and McGrath plans dated December 7, 1990 and <br /> revised on June 2, 1992. <br />
