MA 02649 <br /> TABLE CD" <br /> BOARD OF APPEALS <br /> DECISION TO RESCIND THE <br /> MODIFICATION OF A SPECIAL PERMIT <br /> RE: Cape Cod Restaurants d/b/a Picnic Box - SP-92-52 <br /> The Board of Appeals, at their August 12, 1992 regular meeting, <br /> voted to hold a Public Hearing to determine whether a Modification <br /> of a Special Permit granted to Cape Cod Restaurants d/b/a Picnic <br /> Box, being SP-92-52 should be rescinded for failure to comply <br /> with the conditions of the Modification. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of <br /> Mashpee, on August 21 and August 28, 1992, a copy of which is <br /> attached hereto and made a part hereof. <br /> A Public Hearing was held on Wednesday, September 9, 1992 at <br /> 7:30 P.M. at the Mashpee Town Hall. Board members present and <br /> acting throughout were John J. Friel, Michael A. Makunas and Edward <br /> M. Govoni. <br /> The Board determined that the applicant had not complied with <br /> the conditions of the Modification within the time limits imposed <br /> in the Decision. <br /> The Board found that: <br /> 1. the applicant had not submitted an engineer's plan showing <br /> structures, parking, curb cuts and any improvements in the <br /> appearance or landscaping, <br />
