PARTIES <br /> 1. Plaintiff, Charles M. Talanian, is the Trustee of <br /> Chatal Realty Trust, under Declaration of Trust dated December <br /> 29, 1988 and recorded with the Barnstable County Registry of <br /> Deeds (Land Court) on Certificate of Title No. 116450, and is the <br /> owner of real estate which is the subject matter of the Permit <br /> Granting Authority's decision. <br /> 2 . Defendants,-Michael Makunas, Cheryl Hawver, and John <br /> Friel, are duly appointed members of the Zoning Board of Appeals <br /> for the Town of Mashpee and reside in said Town as follows : <br /> Michael Makunas, 51 James Circle, Mashpee, Barnstable County, MA; <br /> Cheryl Hawver, 52 Great Pines Drive, Mashpee, Barnstable County, <br /> MA; and John Friel,. Uncle Edward's Road, Mashpee, Barnstable <br /> County, MA. <br /> 3 . The Defendant, Edward R. Wasil, is a natural person <br /> believed to be residing at 41 North Bourne's Pond Road, Falmouth, <br /> Barnstable County, Massachusetts . <br /> STATEMENT OF FACTS <br /> 4 . The Plaintiff, Charles M. Talanian, Trustee (herein- <br /> after referred to as "Owner" ) , is the owner of a substantial <br /> parcel of real estate situated at the corner of Route 28 and <br /> onna's Lane (an unimproved public way) in the Town of Mashpee. <br /> 5 . The Owner has for a number of years entered into a <br /> round lease arrangement with the Defendant, Edward R. Wasil <br /> ereinafter referred to as "Applicant" ) , whereby the Applicant <br /> ased the Owner's premises for purposes of conducting various <br /> 2 <br />
