(a) The Board failed to comply with the statutory <br /> provisions for advertising, posting and <br /> notice set forth in M.G.L. c.' 40A; <br /> (b) The decision of the Zoning Board of Appeals, <br /> particularly relating to the imposition of <br /> certain conditions is unreasonable, arbitrary <br /> and capricious, in that the Board: <br /> i. failed to apply applicable standards <br /> set out in the Zoning By-Laws; <br /> ii . reached conclusions which were contrary <br /> to information presented to the Board; <br /> iii. based their decision upon considera- <br /> tions not within the purview of the <br /> Zoning Board of Appeals, but within <br /> the perview of other Boards designated <br /> within the Town of Mashpee to deal <br /> with those considerations; <br /> iv. based their decision upon considera- <br /> tions which exceed that which is <br /> within the purview of the Applicant <br /> to accomplish. <br /> (c) The decision of the Board is based upon <br /> legally untenable grounds, in that certain <br /> conditions imposed by the Board call for <br /> certain duties and responsibilities of the <br /> Applicant on land which is owned by the Town <br /> of Mashpee and the Commonwealth of Massa- <br /> chusetts, and beyond the legal ability of the <br /> Applicant to address . <br /> (d) The conclusion reached by the Board in voting <br /> to impose these certain conditions in <br /> conjunction with the Special Permit is <br /> 5 <br />
