U town of Alaobpee <br /> r , <br /> 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> RE: Karen Jalkut for a Variance - V-92-68 <br /> A Petition.was filed by Karen Jalkut of Sturbridge, Massachusetts <br /> for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the setback requirements in an R-3 zoning district on property <br /> located at 75 Nick Trail (Map 117, Block 100) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on September 25 and October 2, 1992, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 28, 1992 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> John J. Friel, Michael A. Makunas and Edward M. Govoni. <br /> Ms. Jalkut informed the Board that she had placed a shed on her <br /> property last May after checking with her immediate abutters. The <br /> location is within the setback requirements. The Building Inspector <br /> was notified of the violation by a neighbor and the applicant applied <br /> for a Variance. She presented the Board with letters from abutters in <br /> favor of the location. The neighbor, James Candido, an abutter to an <br /> abutter, complained that the shed. was blocking his view to the water. <br /> After discussion with the Board Ms. Jalkut agreed to have the <br /> shed moved to a location 2' from the rear property line and 10' from <br /> the sideline and to provide the Board with new engineer's plans showing <br /> the location and all distances. <br /> Upon motion duly made and seconded the Board of Appeals to grant <br /> a Variance allowing the location 2' from the rear property line and <br /> 10' from the sideline-subject to the receipt of new engineer's plans <br /> showing the exact location. <br />
