Board of Appeals James M. Sivco V-92-80 2. <br /> The Board of Appeals determined that there were <br /> circumstances relating to the topography of the lot in <br /> question which affect the land in questions but not the <br /> zoning district in which it is located and that a <br /> literal enforcement of the by-law would involve <br /> hardship . The Board found that relief could be granted <br /> without derogating from the intent of the by-law or <br /> without detriment to the public good. <br /> Upon motion duly made and seconded the Board of <br /> Appeals voted unanimously on October 28 , 1992 to grant a <br /> Variance of 13 . 3 ' from the side line to the existing <br /> dwelling allowing a setback of 1 . 7 ' and a Variance of <br /> 7 . 8 ' from the corner of the new addition allowing a <br /> setback of 7 . 21 . <br />
