Ball for a Variance V-91-26 <br /> A Petition was filed by Patrick L. Ball of Mashpee, Massachusetts <br /> for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front setback requirement in an R-5 zoning district on <br /> property located at 18 Pequot Road (Map 29, Bluck 91) Mashpee, Massachusetts. <br /> (Owner of record: Rickard K. Snedker) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> general Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on March 25, 1991 and April 2, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, April 10, 1991 at 7:30 P.M. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Cheryl A. Hawver, Michael A. Makunas and William J. Hanrahan. <br /> Attorney Frederick Grosser represented the applicant. He informed <br /> the Board that Mr. Ball had purchased the property at auction and a new <br /> bank survey determined that one of the front setbacks on the corner lot <br /> was 39' I". An earlier survey of the land had recorded the same setback <br /> at 4116". <br /> The Board found that the error in surveying created a hardship, <br /> especially affecting the land in question and not the zoning district <br /> in which the land is located. The Board determined that relief may be <br /> granted without nullifying or derogating from the intent or purpose of <br /> the zoning by-laws and without detriment to the public good. <br />
