MA 02649
BOARD OF APPEALS
DECISION U1r 6
FOR A SPECIAL PERMIT
RE: Petition of Edward A. and Martha M. Palank for a Special Permit
SP-91-28
A. Petition was filed by Edward A. and Martha M. Palank for a
Special Permit under Section 174-17 of the Zoning By-laws for permission
to expand a non-conforming structure with a front addition and second
story in an R-3 zoning district on property located at 181 Daniel's
Island Road (Map 100, Block 39) Mashpee, .MA.
Notice was duly given to abutter's in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in The
Enterprise, a newspaper of general circulation in the Town of Mashpee,
on April 5 and April 12, 1991, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the Petition at the Mashpee Town
Hall on Wednesday, April 24, 1991 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: Cheryl A. Hawver, Michael A. Makunas and William J.
Hanrahan.
Engineer John Slavinsky represented the applicant. He presented
plans for the conversion of a ranch home to a two-story home and
a porch and entrance addition.and informed the Board that the plans
had been approved by the Board of Health and Conservation. No comments
were received from abutters.
The Board found that the use is in harmony with the general .
purposes and intent of the zoning by-laws and complies with the
provisions therein. The Board determined that the extension would
not be more detrimental to the neighborhood than the existing
non-conforming use.
