Austin of East Dennis, MA <br /> for a Special Permit under Sections 174-25.B. 14 and 174-25.E.2 <br /> of the Zoning By-laws for permission to operate a restaurant in a <br /> C-2 zoning district on property located at 470 Main St. (formerly <br /> Ma Glockerner's Restaurant) (Map 27, Block 21) Mashpee, MA. <br /> (Owner of record: Diane Cloutier TR.) <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enterprise, a newspaper of general circulation <br /> in the Town of Mashpee on May 3 and May 10, 1991, a copy of which <br /> is attached hereto and made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, May 22, 1991 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Michael A. Makunas, William J. Hanrahan and John J. <br /> Friel. <br /> Attorney Kevin Kirrane represented the applicant and explained <br /> that the restaurant would be open year round and offer a full menu. <br /> Comments were received from Elias McQuaid, Health Agent, stating <br /> that the Board of Health would require an upgrade of the septic <br /> system, re-approval of the water supply by the D.E.P. and compliance <br /> with fire code and plumbing code requirements as well as the minimum <br /> requirement of food service establishments. Comments were received <br /> from several Mashpee residents in favor of the application. <br /> The Board found that the use is in harmony with the general <br /> purpose and intent of the zoning. by-laws and complies with the <br /> provisions set forth therein. <br />
