BOX 1108 <br /> MASHPEE, MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> RE: Riverbend Realty Trust - N.O.A. 91-36 <br /> In the matter of Riverbend Realty Trust V. the Board of Appeals <br /> (Superior Court Case 1189-606) the Superior Court remanded the case <br /> back to the Board of Appeals. The case was an Appeal of the <br /> Building Inspector's Decision regarding signage at the premises <br /> located at 100 Great Neck Road North (Map 45, Lot 3) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on May 24 and May 31, 1991, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, June 12, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: Cheryl A. Hawver, . Michael 'A. makunas and William J. <br /> Hanrahan. <br /> Attorney Kevin Kirrane represented the applicant. He informed <br /> the Board that the Board of Selectmen had approved the location of <br /> the sign on Town property and that the Design Review Committee had <br /> approved the design of the sign with the removal of interior lighting. <br /> No comments were received from abutters. <br /> The Board of Appeals made the following findings: <br /> 1. The Board of Selectmen had approved the location of the sign <br /> on Town land. <br /> 2. The matter was remanded to the Board for all purposes. <br /> 3. The structure given the approval of the Board of Selectmen is a <br /> pre-existing and non-conforming sign which has existed at its <br /> present location in excess of 15 years. <br />
