MA 02649 <br /> BOARD OF APPEALS <br /> The Mashpee Board of Appeals voted unanimously on Wednesday, <br /> July 11, 1990 to adopt the provisions of Chapter 593 of the Massachusetts <br /> General Laws as follows: <br /> 11 1. When reviewing an application for a Special Permit/Variance <br /> the Board may determine that the assistance of outside consultants is <br /> warranted due to the size, scale or complexity of a proposed project <br /> or because of a project's potential impacts. The Board may require <br /> that applicants pay a "consultants fee" consisting of the reasonable <br /> costs incurred by the Board for the employment of outside consultants <br /> engaged by the Board to assist in the review and analysis of an application. <br /> 2. The fee shall be paid for each application or subsequent <br /> submittal which the Board deems necessary to have reviewed or analyzed <br /> by outside consultants. <br /> 3. In hiring outside consultants, the Board may engage engineers, <br /> planners, lawyers, urban designers or other appropriate professionals <br /> who can assist the Board in analyzing a project to ensure compliance <br /> with all relevant laws, ordinances/by-laws, and regulations. <br /> 4. Funds received by the Board pursuant to this section shall <br /> be deposited with the municipal treasurer who shall establish a special <br /> account for this purpose. Expenditures from this special account <br /> shall be made to carry out the Board's responsibilities under state <br /> and local regulations and only in connection with the specific <br /> project or projects for which a consultant's fee has been or will <br /> be collected from the applicant. <br /> 5. Failure of an applicant to pay a consultant's fee shall <br /> be grounds for the denial of the Special Permit/Variance. <br />
