MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: David Wolff, TR for a Special Permit SP-91-39 <br /> A Petition was filed by David Wolff, TR of New York, New York <br /> for a Special Permit under Section 174-25.I.9 of the Zoning By-laws <br /> for permission to reconstruct an existing pier, ramp and float in <br /> an R-3 zoning district on property located at 12 Cross Tree Way <br /> (Map 112, Block 21) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on July 5 and July 12, 1991, a copy of which is attached hereto and <br /> made a part hereof. <br /> A Public .Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 24, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Michael A. Makunas and Edward M. Govoni. <br /> Attorney Albert Schultz represented the applicant. He reviewed <br /> plans of the existing dock and informed the Board that the float <br /> section had been redesigned at the request of the Conservation <br /> Commission. The area of the floats had been reduced and the dock <br /> extended. No objections were received from the Shellfish or Conservation <br /> Commissions. <br /> The Board found that the use is in harmony with the general <br /> purpose and intent of the Zoning By-laws and complies with the <br /> provisions therein. The Board determined that the structure would <br /> not unduly interfere with free passage of travel by water or land <br /> or cause disruption to the marine or coastal environment. <br />
