MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Robert K. and Myra H. Kraft for a Special Permit SP-91-42 <br /> A-:Petition was filed by Robert K. and Myra H. Kraft of Chestnut <br /> Hill, Massachusetts for a Special Permit under Section 174-17 and <br /> 174-25.1.9 of the Zoning By-laws for an existing pier, ramp and <br /> float in an R-3 zoning district on property located at 24 <br /> Popponesset Island Road (Map 105, Block 254) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on July 5 and July 12, 1991, a copy of which is attached and made a <br /> part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, July 24, 1991 at 7:30 P.M. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William J. Hanrahan, Michael A. Makunas and John J. Friel. <br /> Engineer Stephen A. Wilson represented the applicant and explained <br /> that they are seeking a Chapter 91 Waterways License under the amnesty <br /> program. Paul Somerville, Shellfish Warden, stated that the area of <br /> the pier contained shellfish and recommended that boats be confined <br /> to the float area. No comments were received from the Conservation <br /> Commission. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously to grant the Special Permit with the condition that boat <br /> usage and anchorage be restricted to the float area and that power <br /> boat usage be limited to those with not more than 2 1/2' draft. <br />
