Realty Trust for a Variance V-91-46 <br /> A Petition was filed by S.G.F.S. Realty Trust of Marstons Mills, <br /> Massachusetts for a Variance under Section 174-80.H of the Zoning <br /> By-laws for permission to vary the paving requirements on property <br /> located at 843 Falmouth Road (Map 87, Block 7) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on August 9 and August 16, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, August 28, 1991 at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> Michael A. Makunas, Edward M. Govoni and John J. Friel. <br /> Engineer David Sanicki represented the applicants. He informed <br /> the Board that this application was a duplicate of V-88-09-085 which <br /> had been granted by the Board but had expired. The Variance allowed <br /> an increase in the parking coverage of the lot in order to gain <br /> access to the rear of the building. No comments were received from <br /> the Water District or from abutters. <br /> The Board determined that the shape of the lot created a <br /> hardship and there were no alternative locations to place the building <br /> or provide for parking access. The Board found that there were <br /> circumstances relating to the shape of this lot which did not affect <br /> generally the zoning district in which the land is located and that <br /> relief could be granted without derogating from the intent or purpose <br /> of the zoning by-laws or without detriment to the public good. <br />
